What is the ADSL Service?
The Following Terms & Conditions are those of Hotchilli
1. DEFINITIONS
1.1 "Initial Period" means 12 months.
1.2 "Appropriate Written Notice Period" means 1
(one) month.
2. SERVICE CONTENT
2.1 Upstream connection at up to 256kps upstream. Downstream
connection at up to 500kps with the Hotchilli ADSL 500 service,
up to 1mps with the Hotchilli ADSL 1000 service, and up to
2mpbs with the Hotchilli ADSL 2000 service.
2.2 Connection through BT 's IPStream Service to:
Hotchilli 's network backbone providing Internet access via
all of Hotchilli 's peering points (including the London Exchange
"LINX") and connection to Hotchilli's network links
which includes multiple links to multiple continents (including
USA and Europe and which provides multiple routes in the event
of most single point failures).
2.3 Hotchilli allocated "Static IP" address allowing
Customer connection using Network Address Translation (NAT).
Non-NAT configuration shall only be supported with the prior
written agreement of Hotchilli.
2.4 Domain Name Service (DNS) lookup via Hotchilli's Corporate
DNS Server as Customers' Primary DNS server.
2.5 Customer access to Hotchilli's "USENET" News
server.
2.6 Access to Hotchilli's Help Desk providing technical support
relating to the Service Monday to Friday between 9.00am and
5.30pm (excluding English public holidays).
2.7 Hotchilli reserve the right to examine the use(s) to which
the Service is put by the Customer, in order to identify misuse
or abuse of the service.
3. EQUIPMENT
3.1 Equipment installed by BT, as part of the Service remains
the property of BT at all times. Clause 14.3 of the General
Terms and Conditions shall not apply to such.
3.2 Customers are reminded that as an "always on"
service, their connection is susceptible to unauthorised access
attempts, for which Hotchilli accepts no responsibility. Hotchilli
recommends that Customers look to install suitable equipment
("firewalls") to guard against such attempts.
3.3 Router devices purchased from Hotchilli are all provided
with the equipment manufacturer 's standard warranty and become
Customer 's property and sole responsibility on delivery (subject
to full and final payment). For clarification, a router that
is purchased from Hotchilli is not treated as "Hotchilli
Equipment" in the General Terms and Conditions.
3.4 Router devices leased from Hotchilli are treated as "Hotchilli
Equipment" in the General Terms and Conditions.
4. ACCEPTANCE
4.1 Acceptance of orders is not guaranteed. Furthermore, the
Customer must fulfil minimum user requirements, as detailed
in but not limited to the supporting service information supplied
by Hotchilli.
4.2 Acceptance of orders is subject to agreement of Hotchilli's
General Terms and Conditions and provided payment has been
received for Set-up Fees. Hotchilli reserves the right to
charge an additional set up fee for Installation failures
that result from the Customer being absent on the agreed date
or through the Customer failing to comply with the minimum
user requirements. Fees are non-refundable.
4.3 Customer accepts that the quality of service is dependent
on regional variations in the infrastructure and installation
of the Service, and on the contention of the Service, which
are controlled and maintained by BT and which are beyond the
control of Hotchilli.
4.4 Customer accepts that the Service is provided to a location
as specified by that customer and that any request to subsequently
alter that location (for example if the Customer moves address)
requires a new contract to be entered into, over and above
the existing contract which remains in force.
4.5 While every effort will be made to meet the agreed commencement
date of the Service, Hotchilli cannot be held liable for delays
outside Hotchilli's control.
